Welcome to Kush Art Gallery. These Terms of Service ("Terms") govern your use of our website at kushartgallery.com and any services we provide. By accessing the site or purchasing artwork, you agree to these Terms.

1. About us

Kush Art Gallery is an art gallery located at 13021 Harmon Road, Suite 407, Fort Worth, TX 76177. We sell original modern artwork by our painters and other invited artists, and we host exhibitions, viewings, and commissions.

2. Use of our website

You may use our website for personal, non-commercial purposes. You agree not to:

• Copy, modify, or redistribute content from the site without written permission
• Use automated systems (bots, scrapers) to access the site
• Attempt to interfere with the site's security or operation
• Use the site for any illegal or unauthorized purpose

3. Artwork acquisitions

Originality and authenticity

Every artwork sold through the gallery is an original, one-of-one piece — never reproduced as prints or digital editions. Each piece arrives with a Certificate of Authenticity signed by the artist and the gallery.

Pricing and payment

Prices are listed in U.S. dollars and exclude shipping (unless otherwise noted) and applicable taxes. Texas sales tax (8.25%) applies to deliveries within Texas. We accept major credit cards, ACH transfers, and approved payment plans through Affirm or Klarna.

Holds and reservations

We may hold a piece for up to 7 days with a 10% refundable deposit, allowing you time to arrange viewing or measure your space. After 7 days, the hold expires and the deposit is refunded.

Shipping and delivery

Within Dallas-Fort Worth: complimentary white-glove delivery and installation. Outside DFW: insured crated shipping calculated at checkout. We are not responsible for damage caused by carriers but will work with you on a claim. Title transfers upon delivery and full payment.

Returns

Acquisitions may be returned within 30 days of delivery, in original condition with the Certificate of Authenticity, for a full refund of the artwork price (shipping costs are non-refundable). Custom commissions are non-refundable once accepted by the buyer.

4. Commissions

When you commission a custom piece, the following terms apply:

• A 50% non-refundable deposit is required before work begins.
• The brief, including subject, dimensions, palette, and timeline, is finalized before the deposit and may not be substantially changed afterward without renegotiation.
• Concept revisions are limited per tier (1–3 revisions depending on commission level).
• Final payment is due upon completion. The piece is delivered after final payment clears.
• Once accepted, completed commissions are non-refundable.

5. Featured Artist Program & Exhibition Applications

Acceptance into the Featured Artist Program or any group exhibition is at our sole discretion. Submission of an application does not guarantee acceptance. Accepted artists agree to:

• Provide accurate information about their work and practice
• Comply with the terms of their specific agreement (separately signed)
• Permit the gallery to photograph and market their work during the period of representation

Exhibition fees ($75 flat fee) are non-refundable once paid. Featured Artist Program fees are payable annually or in quarterly installments per the membership agreement. Artist applications are reviewed within 14 days.

6. Events and RSVPs

Exhibition opening RSVPs are subject to capacity. We reserve the right to decline admission if the event is at capacity or if a guest is intoxicated, disruptive, or otherwise behaving inappropriately. Children are welcome but must be supervised at all times.

7. Intellectual property

All artwork sold by the gallery remains the intellectual property of the artist. Acquisition of an artwork includes the physical piece only — copyright, reproduction rights, and exhibition rights are retained by the artist unless explicitly transferred in writing. The gallery's logo, photography, and website content are owned by Kush Art Gallery and may not be used without permission.

8. Disclaimers

Our website and services are provided "as is" and "as available" without warranties of any kind, express or implied. We do not guarantee that the site will be uninterrupted, error-free, or free from viruses. We are not responsible for any indirect, incidental, or consequential damages arising from your use of the site or our services.

9. Limitation of liability

To the maximum extent permitted by law, our total liability arising from your use of the site or any acquisition is limited to the amount you paid for the artwork in question. We are not liable for any losses or damages exceeding that amount.

10. Governing law

These Terms are governed by the laws of the State of Texas. Any disputes will be resolved in the state or federal courts located in Tarrant County, Texas. By using the site, you consent to this jurisdiction.

11. Changes to these terms

We may update these Terms from time to time. The "Last updated" date at the top reflects the most recent version. Continued use of the site after changes are posted constitutes acceptance of the revised Terms.
